The choice to file in Michigan stems from the principal place of business address connected to the debtor, despite the distillery itself being based in Kentucky. Recent reports also show that as of early August, both Luca Mariano Distillery and LMD Holdings LLC were in "Bad" standing with Kentucky’s Secretary of State, indicating lapses in legal compliance.

In a statement to the Lexington Herald-Leader, Viola emphasized that this step aimed “to maximize the value of the assets for all stakeholders.” He expressed confidence in the distillery’s business model, highlighting resilience through prior economic challenges within the whiskey industry and a hopeful outlook toward emerging stronger with support from employees, customers, creditors, and the local community.

Luca Mariano’s situation reflects broader pressures that new distilleries face within Kentucky’s storied bourbon scene—an industry that, while contributing billions to the local economy, remains fiercely competitive with significant operational and financial hurdles.
